When selling your home you will encounter many different real estate seller terms used during the process. By knowing what the terms mean and how they apply during the home sale you can understand what is going on and make sure you do what is needed to keep your home sale on track. Be sure to also check out important real estate terms to be familiar with and important mortgage terms to be familiar with for more real estate terminology.

Breach of Contract – Breach of Contract refers to the event where any party to a contract indicates verbally or through actions that it does not intend to complete the contract. In the case of a home sale an example of breach of contract would be the buyer telling the seller they no longer wish to purchase the home because they found another home they like better. Once the buyer and seller have entered into a contract both parties must perform the actions required of them by the contract. A breach of contract can result in a lawsuit to force the non-performing party to perform or to seek damages for failure to perform.

Contingency Offer – A Contingency Offer is an offer to purchase a home with conditions that must happen first before the home will be purchases. Sometimes home buyers will make an offer to purchase a home that has the condition that they first be able to sell the home they own. If the buyer’s home sells then they will proceed with the purchase of the seller’s home. If the buyer’s home does not sell then the offer for the purchase of the seller’s home ends and the seller is able to put their home back on the market again. While this is one example of a contingency there can be other contingencies made as part of the offer, such as contingent upon the buyer getting a new job in that area of the home, contingent on the buyer’s down payment being matched by their employer and more.

Contingency offers are more risky for home sellers, especially in markets where there are more buyers than home sellers.   By accepting a contingency offer sellers are taking their home off of the market for other buyers who may be able to purchase the home without any contingency of selling an existing home. Sometimes contingency offers contain language stating that the buyer will forfeit the earnest money with the sellers keeping the earnest money in the event the buyers cannot complete the sale due to the condition not being met.

Clouded Title – A cloud on the title means there may be another claim to ownership under the history of the deed that pertains to your home and the land it is on. Often times this may be due to the fact that someone purchased the property in the past and failed to record the deed properly. Depending on the man shocked at reading title reportarea where the property is located this may or may not be more likely to occur. Title Insurance (see below) is designed to ensure that the latest buyer does not suffer a financial loss if there is in fact a clouded title that prevents them from being recorded as the true owner.

General Warranty Deed – A General Warranty Deed is the best type of title for a property transfer as it provides full guarantee of ownership transfer and can be fully insured with Title Insurance. General Warranty Deeds are used when the current owners are in fact the owners of record with the government office where the title is recorded.

Inspection Period – The Inspection Period usually refers to the time after acceptance of the contract by both the seller and buyer during which the buyer’s will usually bring in a home inspector and/or other contractors to evaluate the condition of the home. The amount of time allowed for the inspection period will vary based on local practice. In Cincinnati, Ohio and Northern Kentucky the common time frame is to allow 7 days for a home inspector to perform their inspection and issue their report. The Inspection Period can be extended based on mutual agreement between the buyer and seller.

Multiple Listing Service (MLS) – The MLS is the system where local real estate properties listed for sale through licensed real estate brokers are collected and stored.   Information from the MLS is then shared with the public through broker websites. In order for your home to get the best market coverage available while listed for sale it should be listed on your local MLS with the assistance of a Realtor.

Property Lien – Property Liens are a type of hold put on real estate deeds due to the fact that money is owed (usually taxes or owing money to a contractor) and as a result the property deed cannot be transferred until the liens have been paid off. Once the liens have been paid off the lien holder will release their claim on the deed. In the event a Title Lien is not discovered until after the property has transferred Title Insurance may cover the new owner in this situation depending on the type of policy that was purchased. Mechanic’s Lien can be recorded when a home owner did not pay a contractor for the work that was done to their home.

Title Insurance – Title Insurance is insurance that will pay out to the mortgage company and/or home owner in the event someone else is able to prove they are the owner of the real estate. Due to failure or improper recording of their claim or purchase another buyer of the real estate may in fact have actual ownership if they can prove they previously purchased or had an ownership interest the home. Title Insurance is required by your mortgage lender for the amount of the loan. Title insurance can also be purchased to cover the home buyer over and above amounts to pay off the mortgage in the even the title is clouded.  For more in-depth information on Title Insurance check out my Podcast on Title Insurance.

Possession – Occupancy of the home by the buyer can happen at two different times, on closing or after closing. What this means is the buyer can get control and right of entry to the home on the day of luxury house picture closing or upon some later agreed upon date.

Sometimes sellers may want to stay in the house until they are able to secure new accommodations even though ownership has transferred to the buyer on the date of closing. Post-closing possession usually entails the seller paying to the buyer some rent in order to stay in the home after closing. There is a risk to buyers with this method in that if the sellers refuse to move the buyers must use the eviction process in order to remove the sellers from the home.

Right Of First Refusal – Under Right Of First Refusal an option offer is made on a property whereby a buyer has the first chance to purchase a property if any other offer is made. While not as common in residential sales it is available for buyers to use in case they are not completely ready to purchase a home but still want to be sure they can purchase a particular home in case another buyer is ready and able to buy the home immediately. The answer to this may differ for every person as same is dependent on many variables like personal preferences, location, budget, etc. Here are some of the details that they should pay heed to, at the time of booking.

1. Legality: It's the most important thing to check before buying a flat. In every city there is local government bodies authorized to approve maps of any building. Buyer must check the approvals before entering into agreement or contract.

2. Project Location (Future in Perspective): My views are very different on this particular decision point. It is not necessary always that project on main roads have location advantage compared to the ones located on inside roads. Down the line, after some years you might realize that you have done the mistake by selecting Residential Project located on the main road because of increased traffic sound and commercial activities. Remember we are buying home not office. While selecting any location you should check for basic facilities like grocery store, schools, hospitals, public transport, etc.

3. Price: Well, in the end it all comes down to Price. A buyer must do a complete survey about the prices in location/area in which he is planning to buy the flat/apartment. But there are certain variables which must be kept in mind before you make a decision on the basis of price. These are facilities in the building, specifications of the flat, location, possession date, quality of construction, etc. Also if you like any property and you are not getting it in your budget, don't just walk off but try to negotiate with the builder/developer as I believe that you should not let go your dream home for 5-10%.

4. Features & Specifications: Features are the building facilities and specifications are related to facilities and amenities provided in the flat. Every Builder/Developer gives host of features and specifications to lure buyers. The important part in this regard is to understand which features & specifications are of real use and which are cosmetic.

5. Loan Facility: Generally all reputed builder groups are registered with leading Banks and NBFC's to provide Home Loan facilities to their customers. Whenever any Bank or NBFC approves any project for home loan facility, they provide APF (Approved Project Finance) number to the builder/developer. When customer applies for a home loan, they can just quote the APF number of the project, submit their documents and get loan sanctioned. With APF facility customer is free from the stress of collecting legal documents of the project and submitting them along with his own financial papers. One good thing about project having APF number from leading banks is that this assures you of sound legal & technical credentials of the project.

6. Budget/Add on expenses: Consumer must write down there budget carefully. Property cost is not only the price paid to the builder but there are several add on which you must calculate before finalizing the property. There are add on costs like club membership charges, parking space charges, service tax, stamp duty, registration charges, home loan processing fees, electrification charges, transformer charges, preferred location charges (PLC), etc. Sum of all these expenses is your actual property cost. I have not included maintenance deposit and charges in above list as they do not form part of property acquisition cost but are property maintenance cost. Some Builders have removed all above mentioned charges to make it simple for their customers. Such builders only charge Basic sale price (BSP) for the property.

First, you need to file a police complaint about the lost paper. Then you can apply for a Certified Copy from the sub-registry’s office. Also, give a public notice in newspapers.

If it possible to build the third floor above the second floor without a No Objection Certificate?

You need a No Objection Certificate (NOC) to get your plan sanctioned. You can build the third floor only if it is approved.

Can registry be done by the builder without your presence?

If you have given him the Power of Attorney, the registry can be done by your builder in your absence.

What are the highlights of the report?

In the last ten years, the billionaire count in India has increased by 333 percent while the global growth was just 68 percent, which points to the growth of wealth in India. And these people preferred to invest in real estate sector. The average number of residential properties owned by wealthy individuals stands at 4, while the global average is 3.7, thus highlighting Indian’s inclination towards investment in the realty sector. One-third of wealthy Indians increased their asset allocations to residential real estate over the past decade.

Do the investment preferences of the rich reflect the investment patterns of  majority of Indians?

The size and selection of investments may differ but investors in all financial categories follow more or less the same pattern or have similar preferences. Why just wealthy Indians, even middle-class and lower-income groups dream of owning a home or investing in property and are keen to save all through their lives to buy properties.

Will investment in real estate be preferred in the future?

According to the wealth report, the real estate sector will be a preferred option even in the next 5-10 years. Only after 2025 might there be some change.

Noida has emerged as a major destination for home buyers over the last few years. Noida and Greater Noida, along with Yamuna Expressway and Noida Extension, provide affordable alternatives to middle class buyers in the national capital region. Average home prices in these regions are significantly lower than in Gurgaon, which is associated with high-end apartments.

Here are 5 tips as you go house-hunting in Noida:

1.  Plot versus apartment: You can buy a plot for the price of an apartment along the Yamuna Expressway, which connects Greater Noida with Agra. The world class expressway provides easy access from Delhi. However, don't expect immediate capital appreciation because there is an oversupply of plots in this area. Plots near the F1 track or in the integrated townships coming along the expressway are better options.

2.  Choosing a developer: Projects being developed by an unknown builder, or a first time builder, are prone to execution delays. They will be comparatively cheap, but may remain grounded forever. Samir Jasuja, chief executive officer of PropEquity says buyers should always pay a little premium but go with a reputed or branded developer who will ensure the execution of the project even though it may still get delayed.

3.  Project specification: Small may not always be beautiful. As buildings go taller, large open spaces become a necessity. Look for a project that is adjoining a public park, or has bigger common areas. There will be a small premium between a 25-acre and a 50-acre project to start with, but with time projects with better amenities command a bigger premium.

4.  Absorption: Some areas like the Yamuna Expressway and Noida Extension have large inventories and absorption could continue to slow down. Homes in areas with low absorption rate are less costly, but are suitable only for long term investors, who have a time frame of at least 5-10 years. You should invest in such properties only if you are an end user with no plans to dispose the property.

5.  Geographical factors: Noida and Great Noida have high water table unlike Gurgaon where ground water is not available. Noida has better accessibility to Delhi as compared to Gurgaon, which relies only on the Jaipur Highway. However, both Noida and Gurgaon fall in seismic zone 4, where the risk of earthquakes is pretty high.
